İşbu Çerez ve Aydınlatma Metni, OMNİVERSE SİBER GÜVENLİK VE BİLİŞİM ANONİM ŞİRKETİ (“Omniverse” veya “Şirket”) tarafından işletilen omni-verse.io internet sitesi (“Site”) üzerinden işlenen kişisel verileriniz hakkında, 6698 sayılı Kişisel Verilerin Korunması Kanunu’nun (“KVKK”) 10’uncu maddesi ve Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ uyarınca sizi bilgilendirmek amacıyla hazırlanmıştır.

Metin; Site’deki iletişim formu aracılığıyla işlenen kişisel verileri ve Site’de kullanılan çerezler ile benzeri teknolojileri kapsar. Omniverse, bu kişisel veriler bakımından KVKK uyarınca veri sorumlusu sıfatıyla hareket etmektedir.

2. İletişim Formu Aracılığıyla İşlenen Kişisel Veriler

2.1. İşlenen Kişisel Veriler

• Kimlik: ad soyad,
• İletişim: e-posta adresi, telefon numarası,
• Müşteri işlem: kurum adı, ihtiyaç duyduğunuz hizmet ve mesajınızın içeriği,
• İşlem güvenliği: IP adresi, gönderim zamanı ve güvenlik doğrulaması sonucu.

Mesaj alanına sağlık, biyometrik veri, ceza mahkûmiyeti gibi özel nitelikli kişisel veri yazmamanızı rica ederiz.

2.2. İşleme Amaçları

• Teklif ve bilgi talebinizin değerlendirilmesi, teklif hazırlanması ve sizinle iletişime geçilmesi,
• Hizmet sözleşmesi kurulmasına yönelik görüşmelerin yürütülmesi,
• İletişim formunun ve Site’nin güvenliğinin sağlanması, spam ve kötüye kullanımın önlenmesi,
• Hukuki yükümlülüklerin yerine getirilmesi ve yetkili kurumlara bilgi verilmesi.

2.3. Toplama Yöntemi ve Hukuki Sebepler

Kişisel verileriniz, Site’deki iletişim formunu doldurmanız yoluyla elektronik ortamda ve otomatik yollarla toplanır. Bu veriler KVKK’nın 5’inci maddesinin 2’nci fıkrasındaki şu hukuki sebeplere dayanılarak işlenir:

• (c) bendi: bir sözleşmenin kurulması veya ifasıyla doğrudan ilgili olması kaydıyla, sözleşmenin taraflarına ait kişisel verilerin işlenmesinin gerekli olması (teklif ve sözleşme öncesi görüşmeler),
• (f) bendi: ilgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için veri işlenmesinin zorunlu olması (talebinize yanıt verilmesi, form güvenliği ve kötüye kullanımın önlenmesi),
• (ç) bendi: veri sorumlusunun hukuki yükümlülüğünü yerine getirebilmesi için zorunlu olması.

Bu işleme faaliyetleri için açık rızanız istenmez.

2.4. Saklama Süresi

İletişim formu aracılığıyla iletilen kişisel veriler, talebinizin değerlendirilmesi ve sonuçlandırılması için gereken süre boyunca, sonrasında ise olası uyuşmazlıklara karşı ilgili mevzuatta öngörülen zamanaşımı süreleri boyunca saklanır; bu sürelerin sonunda silinir, yok edilir veya anonim hale getirilir. Form güvenliği amacıyla tutulan IP adresi ve gönderim zamanı kayıtları 24 saat sonra otomatik olarak silinir.

3. Çerezler ve Benzeri Teknolojiler

3.1. Çerez Nedir?

Çerezler, bir internet sitesini ziyaret ettiğinizde bilgisayarınız, tabletiniz, mobil cihazınız veya internet erişimi sağladığınız diğer cihazlar üzerinde saklanabilen küçük metin dosyalarıdır. Site, bazı tercihlerinizi çerez yerine tarayıcınızın yerel depolama alanında (localStorage) saklar; bu Metin’deki “çerez” ifadesi, yerel depolama gibi benzeri teknolojileri de kapsar.

Çerezler kullanım sürelerine göre oturum çerezleri ve kalıcı çerezler, çerezi yerleştiren tarafa göre ise birinci taraf ve üçüncü taraf çerezler olarak sınıflandırılabilir.

3.2. Çerezleri Hangi Amaçlarla Kullanıyoruz?

• Site’nin güvenli ve düzgün şekilde çalışmasını sağlamak,
• Siber güvenliği sağlamak, bot trafiğini ve kötü niyetli faaliyetleri tespit etmek,
• İletişim formunun kötüye kullanılmasını önlemek,
• Çerez ve dil tercihlerinizi hatırlamak,
• Açık rıza vermeniz halinde iletişim bölümündeki haritayı (harici içerik) göstermek.

3.3. Çerez Türleri ve Hukuki Sebepler

Zorunlu çerezler: Site’nin güvenli ve düzgün çalışabilmesi ve açıkça talep ettiğiniz bir hizmetin sunulabilmesi için gereklidir. Güvenliğin sağlanması, bot trafiğinin tespiti, iletişim formunun kötüye kullanımının önlenmesi ve çerez ile dil tercihlerinizin kaydedilmesi amaçlarıyla kullanılır. Dil tercihinin hatırlanması, açıkça talep ettiğiniz bir işlev olduğundan bu kapsamdadır. Zorunlu çerezler bakımından, somut işleme faaliyetine göre KVKK’nın 5’inci maddesindeki açık rıza dışındaki uygun hukuki sebeplerden birine dayanılması halinde ayrıca açık rıza alınmaz. Bu çerezlerin engellenmesi Site’nin bazı fonksiyonlarının düzgün çalışmamasına neden olabilir.

İşlevsellik ve harici içerik çerezleri: Site’nin iletişim bölümündeki harita, Google LLC tarafından sağlanan Google Haritalar hizmeti üzerinden gösterilir. Harita yüklendiğinde Google kendi çerezlerini yerleştirebilir ve IP adresiniz gibi verileri işleyebilir. Bu nedenle harita yalnızca açık rızanızla yüklenir: Çerez Tercih Paneli’nde “Harici içerik” kategorisini onaylamanız veya harita alanındaki “Haritayı göster” düğmesine basmanız gerekir. Rıza vermediğiniz sürece harita yüklenmez; adresimize “Haritada aç” bağlantısıyla Google Haritalar üzerinden ayrıca ulaşabilirsiniz.

Performans ve analitik çerezleri: Site’de şu anda kullanılmamaktadır.

Reklam ve pazarlama çerezleri: Site’de kullanılmamaktadır.

Performans, analitik, reklam veya pazarlama çerezlerinin ileride kullanılması halinde bu çerezler açık rızanız olmadan çalıştırılmaz; bu Metin ve Çerez Tercih Paneli buna göre güncellenir.

Kullanılan çerezin niteliğine bağlı olarak IP adresi, cihaz ve tarayıcı bilgileri, oturum ve doğrulama bilgileri, erişim zamanı, yönlendiren internet sitesi bilgisi, çerez ve dil tercihleri, iletişim formu gönderim zamanları ile güvenlik ve işlem kayıtları işlenebilir. Omniverse’in yerel depolama kayıtları yalnızca cihazınızda tutulur ve Omniverse’e iletilmez.

3.6. Çerez Tercihlerinizi Nasıl Yönetebilirsiniz?

Site’yi ilk ziyaretinizde sunulan Çerez Tercih Paneli’nde Tümünü Kabul Et, Tümünü Reddet ve Tercihleri Yönet seçenekleri yer alır. Zorunlu olmayan ve açık rıza gerektiren çerezler, siz onay vermediğiniz sürece etkinleştirilmez.

Tercihinizi istediğiniz zaman Site’nin alt kısmındaki “Çerez Tercihleri” bağlantısından değiştirebilir, verdiğiniz açık rızayı geri çekebilirsiniz. Tercihiniz 12 ay boyunca saklanır; bu sürenin sonunda yeniden sorulur. Açık rızanın geri çekilmesi, geri çekme işleminden önce gerçekleştirilen veri işleme faaliyetlerinin hukuka uygunluğunu etkilemez.

Çerez tercihlerini yönet

Ayrıca tarayıcınız üzerinden çerezleri ve yerel depolama kayıtlarını görüntüleyebilir, silebilir veya engelleyebilirsiniz. Harita yüklendikten sonra rızanızı geri çekerseniz, Google tarafından daha önce yerleştirilmiş çerezleri tarayıcı ayarlarınızdan silebilirsiniz.

4. Kişisel Verilerin Aktarılması

Kişisel verileriniz, yukarıda belirtilen amaçlarla sınırlı olarak;

• Site’nin barındırılması, iletişim formunun çalıştırılması ve güvenliğinin sağlanması amacıyla altyapı ve güvenlik hizmeti sağlayıcımız Cloudflare, Inc.’e,
• form içeriğinin ekibimize e-posta ile iletilmesi amacıyla e-posta altyapısı hizmeti sağlayıcılarımız Resend, Inc. ve Microsoft’a,
• açık rıza vermeniz halinde harita gösterimi amacıyla Google LLC’ye,
• talep edilmesi halinde kanunen yetkili kamu kurum ve kuruluşlarına

aktarılabilir. Bu hizmet sağlayıcılarının sunucuları yurt dışında bulunabilir. Yurt içine ve yurt dışına aktarımlar, KVKK’nın 8’inci ve 9’uncu maddelerinde belirtilen şartlara uygun olarak gerçekleştirilir.

5. KVKK Kapsamındaki Haklarınız ve Başvuru

KVKK’nın 11’inci maddesi kapsamında Omniverse’e başvurarak;

• kişisel verilerinizin işlenip işlenmediğini öğrenme,
• kişisel verileriniz işlenmişse buna ilişkin bilgi talep etme,
• kişisel verilerinizin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
• yurt içinde veya yurt dışında kişisel verilerinizin aktarıldığı üçüncü kişileri bilme,
• kişisel verilerinizin eksik veya yanlış işlenmiş olması halinde bunların düzeltilmesini isteme,
• KVKK’nın 7’nci maddesinde öngörülen şartlar çerçevesinde kişisel verilerinizin silinmesini veya yok edilmesini isteme,
• düzeltme, silme veya yok etme işlemlerinin kişisel verilerinizin aktarıldığı üçüncü kişilere bildirilmesini isteme,
• işlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme,
• kişisel verilerinizin kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız halinde zararın giderilmesini talep etme

haklarına sahipsiniz.

Bu haklarınıza ilişkin taleplerinizi, Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ’e uygun olarak, Kişisel Verilerin Korunması sayfamızda yer alan İlgili Kişi Başvuru Formu ile Omniverse’e iletebilirsiniz. Başvurunuz, talebin niteliğine göre en kısa sürede ve en geç 30 gün içinde ücretsiz olarak sonuçlandırılır; işlemin ayrıca bir maliyet gerektirmesi halinde Kişisel Verileri Koruma Kurulu tarafından belirlenen tarifedeki ücret alınabilir. 6. Metnin Güncellenmesi

Omniverse; mevzuatta meydana gelebilecek değişiklikler, kullanılan teknolojiler veya Site üzerinde işlenen kişisel verilerin ve kullanılan çerezlerin değişmesi nedeniyle işbu Metni güncelleyebilir. Metnin güncel sürümü omni-verse.io üzerinde yayımlandığı tarihten itibaren geçerli olur.

This Cookie and Privacy Notice has been prepared by OMNİVERSE SİBER GÜVENLİK VE BİLİŞİM ANONİM ŞİRKETİ (“Omniverse” or the “Company”) to inform you, under Article 10 of Turkish Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Procedures and Principles for Fulfilling the Obligation to Inform, about the personal data processed through the omni-verse.io website (the “Site”).

It covers personal data processed through the contact form on the Site and the cookies and similar technologies used on the Site. Omniverse acts as the data controller for this personal data under the KVKK.

2. Personal Data Processed Through the Contact Form

2.1. Personal Data Processed

• Identity: full name;
• Contact: email address, phone number;
• Customer transaction: company name, the service you need and the content of your message;
• Transaction security: IP address, submission time and the result of the security verification.

Please do not include special categories of personal data, such as health or biometric data or criminal convictions, in your message.

2.2. Purposes of Processing

• evaluating your quote or information request, preparing a quote and contacting you;
• conducting discussions aimed at entering into a service agreement;
• keeping the contact form and the Site secure and preventing spam and abuse;
• fulfilling legal obligations and providing information to competent authorities.

2.3. Method of Collection and Legal Bases

Your personal data is collected electronically and by automated means when you fill in the contact form on the Site. It is processed on the following legal bases under Article 5(2) of the KVKK:

• paragraph (c): processing is necessary for the conclusion or performance of a contract, provided that it directly relates to it (quotes and pre-contractual discussions);
• paragraph (f): processing is necessary for the legitimate interests of the data controller, provided that it does not harm your fundamental rights and freedoms (responding to your request, form security and abuse prevention);
• paragraph (ç): processing is necessary for the data controller to comply with a legal obligation.

Your explicit consent is not requested for these processing activities.

2.4. Retention Period

Personal data submitted through the contact form is retained for as long as necessary to evaluate and conclude your request and thereafter for the limitation periods set out in the applicable legislation in case of potential disputes; at the end of these periods it is deleted, destroyed or anonymised. IP address and submission-time records kept for form security are automatically deleted after 24 hours.

3. Cookies and Similar Technologies

3.1. What Is a Cookie?

Cookies are small text files that may be stored on your computer, tablet, mobile device or any other device you use to access the internet when you visit a website. The Site stores some of your preferences in your browser’s local storage (localStorage) rather than in cookies; in this Notice the term “cookie” also covers similar technologies such as local storage.

By lifetime, cookies may be session or persistent cookies; by the party that sets them, they may be first-party or third-party cookies.

3.2. Why Do We Use Cookies?

• to make sure the Site works securely and correctly;
• to ensure cybersecurity and detect bot traffic and malicious activity;
• to prevent abuse of the contact form;
• to remember your cookie and language choices;
• to show the map in the contact section (external content) if you give your explicit consent.

3.3. Types of Cookies and Legal Bases

Essential cookies: required for the Site to work securely and correctly and to provide a service you have explicitly requested. They are used to keep the Site secure, detect bot traffic, prevent abuse of the contact form and store your cookie and language choices. Remembering your language falls into this category because it is a function you explicitly request. Where essential cookies rely on one of the legal bases under Article 5 of the KVKK other than explicit consent, no separate consent is requested. Blocking them may prevent some functions of the Site from working correctly.

Functional and external content cookies: the map in the contact section is shown through Google Maps, a service provided by Google LLC. When the map loads, Google may set its own cookies and process data such as your IP address. The map therefore loads only with your explicit consent: you need to allow the “External content” category in the Cookie Preferences panel or press “Show map” in the map area. Without your consent the map is not loaded; you can still find our address on Google Maps through the “Open in maps” link.

Performance and analytics cookies: not currently used on the Site.

Advertising and marketing cookies: not used on the Site.

If performance, analytics, advertising or marketing cookies are introduced in the future, they will not run without your explicit consent, and this Notice and the Cookie Preferences panel will be updated accordingly.

3.5. Data That May Be Processed Through Cookies

Depending on the cookie, your IP address, device and browser information, session and verification information, time of access, referring website, cookie and language choices, contact form submission times and security and transaction logs may be processed. Omniverse’s local storage entries are kept only on your device and are not sent to Omniverse.

3.6. How Can You Manage Your Cookie Preferences?

The Cookie Preferences panel shown on your first visit offers Accept all, Reject all and Manage preferences. Non-essential cookies that require explicit consent are not enabled unless you agree.

You can change your choice or withdraw your consent at any time via the “Cookie Preferences” link at the bottom of the Site. Your choice is stored for 12 months, after which you are asked again. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.

Manage cookie preferences

You can also view, delete or block cookies and local storage entries through your browser. If you withdraw consent after the map has loaded, you can delete cookies previously set by Google in your browser settings.

4. Transfer of Personal Data

Limited to the purposes above, your personal data may be transferred to:

• Cloudflare, Inc., our infrastructure and security provider, to host the Site, run the contact form and keep them secure;
• Resend, Inc. and Microsoft, our email infrastructure providers, to deliver the content of the form to our team by email;
• Google LLC, if you give explicit consent, to display the map;
• competent public authorities, where legally required.

These service providers’ servers may be located outside Türkiye. Transfers within Türkiye and abroad are carried out in accordance with the conditions set out in Articles 8 and 9 of the KVKK.

5. Your Rights Under the KVKK and How to Apply

Under Article 11 of the KVKK, you have the right to apply to Omniverse to:

• learn whether your personal data is processed;
• request information about the processing if it has been processed;
• learn the purpose of the processing and whether the data is used in line with that purpose;
• know the third parties in Türkiye or abroad to whom your personal data is transferred;
• request correction if your personal data is incomplete or inaccurate;
• request deletion or destruction of your personal data under the conditions set out in Article 7 of the KVKK;
• request that correction, deletion or destruction be notified to third parties to whom your data was transferred;
• object to a result against you arising from analysis of the data exclusively through automated systems;
• claim compensation for damages arising from unlawful processing of your personal data.

You can submit requests concerning these rights to Omniverse using the Data Subject Application Form on our Personal Data Protection page, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller. Your application is concluded free of charge as soon as possible and within 30 days at the latest, depending on the nature of the request; if the action requires an additional cost, a fee may be charged according to the tariff set by the Personal Data Protection Board. 6. Updates to This Notice

Omniverse may update this Notice due to changes in legislation, in the technologies used, or in the personal data processed and cookies used on the Site. The current version takes effect on the date it is published on omni-verse.io. In case of any discrepancy, the Turkish version of this Notice prevails.
